Liability Waiver – to be signed upon registration
LITTLE SPLASHES SWIM SCHOOL
I, the undersigned enrolled participant and/or the parent/guardian of the participant, desire to participate in swimming lessons, swim classes, certification classes, swim parties, and/or other swim-related activities (the “Activities”) offered by Little Splashes Swim School. In consideration for being permitted by the Company to participate in the Activities, the undersigned I agree to all the terms and conditions set forth in this agreement (this “Agreement”).
I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE DANGEROUS AND INVOLVE THE RISK OF DROWNING, SERIOUS INJURY AND/OR DEATH. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGERS INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY OR DEATH.
I EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS AGAINST THE COMPANY, AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS AND ASSIGNS (COLLECTIVELY, “RELEASEES”), ON ACCOUNT OF INJURY OR DEATH ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE ACTIVITIES, WHETHER ARISING OUT OF THE NEGLIGENCE OF THE COMPANY OR ANY RELEASEES OR OTHERWISE. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST THE COMPANY OR ANY OTHER RELEASEE, AND FOREVER RELEASE, DISCHARGE, AND HOLD THE COMPANY AND ALL OTHER RELEASEES HARMLESS FROM LIABILITY UNDER SUCH CLAIMS. I hereby authorize any representatives of the Company to have the participant treated in any medical emergency during his/her participation in the Activities. Further, the participant and/or parent/guardian agrees to pay all costs associated with medical care for and transportation of the participant. I have notified the Company in writing of any medical/health problems of which the Company’s staff should be aware before participating in the Activities. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.

Make-up Policy Agreement
Every effort to fairly handle absences due to serious illness will be made. Missing a lesson due to the occasional sniffles, naps, doctors appointments, vacations or simply forgetting the lesson is the sole responsibility of the parent(s)—no make-up for these situations. If lessons are canceled due to pool malfunction or the teacher’s illness, there will be one make-up class or credit towards the next session.
Covid-19 Policy
Unfortunately, due to the long length of the closures and the short length of the swim season, as well as previous experiences with Covid-19 closures, Little Splashes, LLC will not be able to offer make-up or credit for lessons canceled due to Covid-19. Little Splashes, LLC is a small business and the pool and staff are still being paid even if classes are canceled for reasons that are out of our control. So, to try and make sure we limit this as much as possible, we will be extra cautious around the pool.
Safety is paramount for teachers, students, parents and guardians. We will implement additional hand-cleaning measures[SK1] as the CDC recommends (learn more at https://www.cdc.gov/ ). Masks are required for adults and children over 2 in both the changing areas and the waiting areas; however, we will not be wearing masks in the pool, as masks are not advised in swimming pools, and especially not for children aged 2 and younger.

Please also let Little Splashes, LLC know immediately. This is a list of the symptoms of COVID-19 from the CDC. Knowledge about Covid-19 changes frequently, so please be aware of and follow the guidance provided by cdc.gov.
Little Splashes, LLC will notify all families as soon as possible if it learns of possible exposure through its classes. Little Splashes, LLC will also fully cooperate with state contact tracers to help contain the virus, which may mean sharing your information with the state contact tracers.
Refund Policy
*No refunds will be given* Once we have reserved your time slot, that spot is considered sold and no longer marketable. Please feel free to give or sell your child’s time slot to a family member or friend if the lessons cannot be made. Kindly understand that when you schedule lessons, you must ensure that vacation, appointments, and health concerns do not interfere with your scheduled lessons. Full payment is due at the time of registration. A payment plan can be made by emailing Hannah at Littlesplashes@gmail.com.
MAKE-UP POLICY-
We understand the importance of our clients' time and commitments and strive to create a fair and accommodating environment. In the event of serious illness, we will do our best to address absences appropriately. However, it is essential to note that missing a lesson due to occasional sickness, napping, doctor's appointments, vacations, or forgetting a lesson is the sole responsibility of the parent(s), and make-up classes will not be provided for these situations.
We also recognize that unforeseen circumstances, such as pool malfunctions or teacher's illness, can sometimes occur. In such cases, we are committed to providing a solution. If a lesson is canceled for these reasons, we will offer either one make-up class or credit towards the next session. Please remember that our pool availability is limited to certain days and times.
MAKE-UP WEATHER POLICY-
At Little Splashes Swim School, we understand that weather conditions can occasionally disrupt our scheduled swimming lessons. Since weather cancellations are beyond our control, our policy ensures fair treatment for both our staff and our students.
Staff Compensation: In the event of weather-related cancellations, our staff will still be compensated for their scheduled hours. We value their dedication and recognize their commitment to our swim school, even during unforeseen disruptions.
Limited Rental Space: Please note that our swim school operates within limited rental space. While we strive to accommodate makeup lessons, our ability to schedule additional sessions may be constrained by the availability of facilities.
Makeup Days: If available, we will offer a make-up class to address weather-related cancellations.
We appreciate your understanding and cooperation regarding our weather cancellation policy. Despite our best efforts, some disruptions may occur due to factors beyond our control.
